Terms and Conditions
1. Scope and provider
(1) These terms apply to all contracts for access to the AIsellence City Guide (“City Guide”) concluded with us by consumers (“customer”).
(2) The provider and contracting party is AIsellence UG (haftungsbeschränkt), represented by its managing director Frederic Ananou, Pleimesstraße 3, 53129 Bonn, Germany, Bonn Local Court HRB 29507, VAT ID DE452276535, email: kontakt@aisellence.ai, phone: +49 151 25305051.
(3) Deviating terms of the customer do not apply.
2. Service
(1) The City Guide is a digital city walk provided via the WhatsApp messenger. It consists of spoken explanations (voice messages), images, a map with stops and navigation links.
(2) By purchasing a pass, the customer receives access to all stops of the chosen city for the selected duration (1 day = 24 hours, 2 days = 48 hours or 1 week = 7 days). The duration starts with the activation immediately after purchase.
(3) Access to the sights themselves (e.g. admission, opening hours, accessibility of paths) is not part of the service. Navigation is provided by third-party map services (Apple Maps, Google Maps); we are not responsible for their content or availability.
(4) We may update content and change individual stops as long as the walk remains equivalent overall.
3. Requirements
The customer needs a smartphone with WhatsApp installed, their own WhatsApp account and an internet connection. WhatsApp’s terms of service apply. Connection costs (e.g. mobile data, roaming) are borne by the customer.
4. Conclusion of contract
(1) The customer starts the City Guide by sending a message to our WhatsApp number (e.g. via a QR code), chooses a language and then a pass.
(2) The customer is then redirected to a payment page of our payment provider Stripe, showing the pass and the total price. By clicking “Pay”, the customer makes a binding offer to purchase the pass.
(3) The contract is concluded once payment has been completed successfully and we activate access. The customer receives a confirmation in the WhatsApp chat and a payment receipt by email.
(4) Contract languages are German and English. These terms can be viewed at any time at aisellence.ai/cityguide/terms. In case of doubt, the German version prevails.
5. Prices and payment
(1) The prices shown in the chat and on the payment page at the time of the order apply. All prices are final prices including statutory VAT.
(2) Payment is processed by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland) by credit card, debit card, Apple Pay or Google Pay.
6. Activation by code
(1) Partner businesses (e.g. hotels) may sell the pass in their own name for cash or card payment and give the customer a code. In this case the purchase of the code is a contract between the customer and the partner; after the code is redeemed, we provide the City Guide under these terms.
(2) A code is only valid for the city and duration for which it was issued and can only be redeemed until the stated date. There is no entitlement to a cash payout.
7. Right of withdrawal
Consumers have a right of withdrawal as set out in the cancellation policy (aisellence.ai/cityguide/withdrawal). The right of withdrawal expires early if the customer has expressly agreed that we begin providing the service before the withdrawal period ends and has acknowledged that they thereby lose their right of withdrawal once provision begins.
8. Warranty and availability
(1) The statutory provisions on digital products apply (sections 327 et seq. German Civil Code).
(2) The City Guide is designed for use around the clock. Interruptions caused by WhatsApp/Meta, mobile networks or other third parties are beyond our control. If the City Guide is unavailable for a substantial part of the pass duration for reasons we are responsible for, we extend the pass accordingly or refund the price pro rata, or in full at the customer’s request.
(3) The customer can report problems at any time to kontakt@aisellence.ai.
9. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the customer may regularly rely), liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
(3) The customer uses the City Guide on the move at their own responsibility, pays attention to traffic, paths and weather, and listens only where it is safe to do so.
10. Rights of use
The content of the City Guide (texts, recordings, images, maps) is protected by copyright. The customer receives a simple, non-transferable right of personal use for the duration of the pass. Sharing, recording for distribution or public playback is not permitted.
11. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
